These Terms of Use (“Terms”) govern your access to and use of the mcpvillage website hosting service (“mcpvillage”, the “Service”, “we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
mcpvillage provides hosting and editing tools for simple websites. You connect your own third-party AI assistant (such as Claude, OpenAI, Grok, or Kimi) to the Service through a Model Context Protocol (“MCP”) connection and build or edit your site by instructing that assistant. We host your site and provide a subdomain or custom domain with TLS, basic form processing, and basic analytics. We do not provide the AI assistant; you are responsible for your own AI provider and its fees, terms, and output.
2. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for all activity under your account, for keeping your login and any MCP access tokens confidential, and for any actions taken by an AI assistant you connect. Notify us immediately of any unauthorized use. You must provide accurate information and keep it current.
3. Acceptable Use
You are solely responsible for your site, its content, and everything done through your account or a connected AI. You agree not to use the Service to create, host, store, transmit, or link to anything that:
- is illegal, or promotes or facilitates illegal activity;
- is sexually explicit, pornographic, or “adult” content, or that sexualizes or endangers minors in any way;
- is fraudulent, deceptive, or a scam — including phishing, fake storefronts, deceptive “get-rich-quick” offers, pyramid or Ponzi schemes, or impersonation;
- infringes or misappropriates any intellectual property, privacy, publicity, or other right of any third party;
- is defamatory or harassing, or promotes violence, self-harm, terrorism, or hatred or discrimination against any group;
- contains malware, viruses, or code intended to disrupt, damage, or gain unauthorized access to systems or data;
- distributes unsolicited bulk messages (spam) or harvests personal data without consent;
- probes, scans, overloads, or circumvents the security, rate limits, or resource limits of the Service, or uses the Service as a general-purpose file store, content-delivery network, proxy, or for cryptomining.
Restricted: financial, crypto, and high-risk content. Cryptocurrency, digital tokens, NFTs, token sales or ICOs, securities and investment offerings, and gambling are restricted. We may require prior written approval and may refuse, limit, suspend, or remove such content at our sole discretion.
We may, but are not obligated to, review content. We may remove content and suspend or terminate accounts that we believe (in our sole discretion) violate these Terms, are harmful, or expose us or others to liability or legal risk — with or without notice.
4. Your Content
You retain ownership of the content you create or upload (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, cache, back up, transmit, display, and serve Your Content as needed to operate and provide the Service. You represent that you have all rights necessary to grant this license and that Your Content does not violate these Terms or any law. You are responsible for keeping your own copies; while we maintain backups, we do not guarantee them.
5. Your AI Assistant and Automated Changes
The AI assistant you connect is a third-party service that you control. Instructions you give it, and changes it makes to your site, are your responsibility as if you made them yourself. We are not responsible for the assistant’s availability, output, accuracy, or actions, or for any fees charged by your AI provider. AI-generated content can be inaccurate; you are responsible for reviewing it and for everything published on your site.
6. Visitor Data and Forms
If you collect information from visitors (for example, via forms, leads, or contact features), you are the controller of that information. You are responsible for obtaining any required consents, posting your own privacy notice, and handling that data lawfully. We process visitor and analytics data on your behalf as described in our Privacy Policy.
7. Fees, Renewal, and Refunds
Paid plans are billed in advance on a recurring basis and renew automatically until cancelled. You authorize us and our payment processor to charge your payment method. Fees are non-refundable except where required by law. We may change pricing or plan features on notice, effective at your next renewal. Failure to pay may result in suspension or termination.
8. Suspension and Termination
We may suspend or terminate your access at any time for violation of these Terms, non-payment, suspected fraud or abuse, legal requirement, or to protect the Service or others. You may stop using the Service and cancel at any time. On termination, your right to use the Service ends and we may delete your site and data after a reasonable period. Provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) survive termination.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT DATA WILL NOT BE LOST. YOU USE THE SERVICE AT YOUR OWN RISK.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MCPVILLAGE AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.
11. Indemnification
You will defend, indemnify, and hold harmless mcpvillage and its owners, employees, and suppliers from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from or related to Your Content, your site, your use of the Service, your violation of these Terms or any law, or your infringement of any third-party right.
12. Copyright
If you believe content on the Service infringes your copyright, contact us at the address below with the information required by applicable law. We may remove allegedly infringing content and terminate repeat infringers.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted here with a new “last updated” date and, where appropriate, notified to you. Your continued use after changes take effect constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of [governing-law jurisdiction to be confirmed], without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to small-claims court.
